Events Terms and Conditions

PREAMBLE

These Terms and Conditions shall apply to free and paid Events, also referred to as Activities, organised by Afro-Caribbean Matchmaking Agency whose website is https://blackdatingv.com/matchmaking/ (hereinafter “ACMA”) and available on the Websites for any person who is a Member or Subscriber.
By registering and participating in Events or Activities, the Participant fully accepts these Terms and Conditions.

ARTICLE 1 – DEFINITIONS

Words or phrases commencing with a capital letter shall have the following meaning:

Account refers to the strictly personal interface accessible by and allowing Members or Subscribers to log in to the Websites in order to benefit from the Services they have registered or subscribed to, complete or modify their profile and, if needed, renew or modify their Subscription.

Core Dating Websites refers to the Websites accessible to all Members and Subscribers.

Event or Activity both refer to, depending on the Website delivering the Service, any free or paid event allowing Members and Subscribers and, if applicable, their Guests to meet in person.

Events Page refers to a page on the Websites dedicated to a specific Event or Activity, containing a description of the Event or Activity and allowing participants to register.

Guest refers to any user who, without being a Member or Subscriber, may participate in Events or Activities following invitation from a Member or Subscriber.

Member refers to a user enjoying access to one of the Services following registration on the Websites.

Participant refers to a Member, Subscriber or Guest registered to participate in an Event or Activity.

Services refers to all services, paid or free, accessible to ACMA Members and Subscribers provided on the Websites of ACMA.

Specialised Websites refers to Websites dedicated to specific categories of Members or Subscribers.

Subscriber refers to a client of one or more Services who has validly purchased a Subscription to one or more Services.

Subscription refers to a paid package giving access to paid Services for a limited time, specified in the subscription purchased by a Member.

Website refers to any ACMA website, namely the ACMA website, the Core Dating Websites and Specialised Websites, as well as the ACMA mobile applications, through which the Services, including an Events Page, are provided.

ARTICLE 2 – EVENT REGISTRATION

2.1 Conditions for registration

Individuals over 18 who are Members or Subscribers of the relevant Services, may register for free or paid Events.

Members or Subscribers wishing to register for an Event must first log in on the Website with the Events Page using his/her email address and unique password.

The Member or Subscriber is solely responsible for how his/her confidential username or password or other identifiers is used whether to make statements, actions, whether fraudulent or not, by third parties and will indemnify and hold ACMA harmless against any claims in this respect unless in the case of wrongdoing exclusively attributable to ACMA or technical failure of the Services. Furthermore, ACMA is not required nor does it have the technical capacity to verify the identity of individuals who register for its Events. If a Member or Subscriber believes someone else is using their credentials, the Member or Subscriber must without delay inform ACMA using the contact methods provided in article 14 below.

2.2 How to register

In order to register for an Event, free or paid, the Member or Subscriber must:

  • Provide the necessary information for their registration on the Events Page
  • Read and fully accept these Terms and Conditions along will any additional conditions specific to certain Event.
  • Make payments in accordance with the conditions and price associated with the respective paid Events.

ACMA will confirm the registration and/or purchase by sending a confirmation email, which signals the finalising of the contract between ACMA and the Participant.
Before confirming the registration for the chosen Event, the Member or Subscriber must ensure that all the information displayed is correct and aligns with the information he/she provided as it cannot be changed after the contract has been finalized.

2.3 Inviting Guests

Each Member or Subscriber may invite unlimited guest to any event they register for as long as they provide ACMA the guest details in advanced of the Event he/she has registered for.
Only the Member or Subscriber enters into a contract with ACMA. The Member or Subscriber must pay the participation fee of their invited Guests in accordance with the conditions and price associated with the Event.
When a Member or a Subscriber provides the Guest’s contact information to ACMA, including his/her surname, first name and email address, he/she undertakes to have received prior consent for the Guest’s data to be processed by ACMA in accordance with the conditions described in article 12 below, and provides them under his/her sole responsibility.
ACMA will only use the Guest’s information to send an email which acquaints them of the Event and all associated conditions associated with it on behalf of the Member or Subscriber who provided their contact details to ACMA.

2.4 Minimum number of Participants

The continuance of an Event may be subject to a minimum or maximum number of participants in accordance with the information provided, if applicable, on the relevant Events Page of the Websites.
ACMA reserves the right to cancel an Event and reimburse Members and Subscribers in accordance with article 5 of these Terms and Conditions.

ARTICLE 3 – PRICE AND PAYMENT

Unless otherwise noted, all paid Events are priced in British pounds sterling and all taxes included.

The Member or Subscriber can pay the EVENT cost for his/herself or his/her GUESTS using any of the following methods:

  • by card (online or via mobile banking)
  • using an online payment service (Paypal, Direct Debit, etc.) depending on the available options on the relevant Website.
  • directly at the venue location for certain Events, without need for prior registration and depending on space availability.

ARTICLE 4 – NO RIGHT OF WITHDRAWAL

In accordance with Article 28 (1) (h) of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 , the Participant is informed that the Events are subject to the right of withdrawal only in exceptional circumstances.

Subsequently, the Member or Subscriber acknowledges that any registration for Events carried out on the Website is final and cannot be reimbursed by ACMA, other than in accordance with article 5 of the Terms and Conditions.

As a result, if the Participant fails to attend or is unable to take part in the Event at the designated time and place stated in his/her contract, no refund will be issued nor will any refund be provided to the paying Subscriber or the Member, if applicable, for the participation of one or more Guests.

ARTICLE 5 – MODIFICATION OR CANCELLATION OF AN EVENT BY ACMA

5.1 Modification of an Event

If, before an event commences, ACMA has to postpone, or change the Event (date, time, place), all participants will be notified by email by ACMA as soon as is possible.

The Participant will have at least forty-eight (48) hours before the modified Event date indicated by ACMA to respond with their decision. Failure to reply within the time indicated will mean a forfeiture of all opportunity to request a refund for the Event initially registered for.

If the Participant is not interested in the modified Event, the Participant have the latest forty-eight (48) hours before the new Event date to terminate the contract by any means. The participant will then be entitled to a full refund with no extra charge, (if applicable) within 30 days.

5.2 Cancellation of an Event

If ACMA has to cancel an Event, all Participants shall be informed by any means and reimburse the full amount paid within 30 days.

ARTICLE 6 – CONDITIONS FOR ACCESS AND PARTICIPATION IN EVENTS

6.1 Conditions for access

Once the Member or Subscriber has registered for an Event, they along with any Guest shall enjoy strictly personal access to this Event, once they have met registration conditions and, if applicable, paid for the relevant Event.

There are certain conditions that might preclude any Member or Subscriber or Guest from an Event in the following scenarios:

  • The Member, Subscriber or Guest has not registered for the Event.
  • The registration or payment conditions have not been satisfied by the Member, Subscriber or Guest before the Event commences or before the stipulated deadline.
  • The behavior of the Member, Subscriber, or Guest is not in alignment with the conditions or organisation of the Event, is contrary to public order, decency, health or safety stipulations, or is posing a risk for the decency or safety of a third party.
  • The venue or Event might not be suitable to accommodate persons with disability or reduced mobility. ACMA cannot undertake the responsibility to provide for these individuals specific needs. As such, if the Participant needs a chaperone, that person must also be registered for the Event as a participant.

Finally, it is restated here that a Guest who takes part in an Event is understood to have accepted these Terms and Conditions that were emailed to him/her at the address provided by the Member or Subscriber who invited him/her to the Event.

6.2 Sporting Events

All Participants should ensure their state of health allows them to participate in sporting Events or that the necessary precautions are taken by them in lieu of their state of health in order to avoid creating liability for ACMA in cases where there is an incident or accident resulting from their lack of precaution in participating I an Event that was deleterious based on their state of health.

ACMA or its subcontractor might require Participants to sign a waiver of liability signaling their state of health is commensurate with the sporting Event.

If a Participant is unable to participate in an Event for medical reasons, ACMA will not refund the payment made for that Event by the Participants.

ARTICLE 7 – CODE OF CONDUCT

We aim to have every Event being enjoyable and safe for all Participants. As such, all Members, Subscribers and, if applicable, their Guests agree to conduct themselves in alignment with our Code of Conduct:

  • Be friendly
  • Be genuine
  • Engage in clean and constructive conversations
  • Follow instructions given by the Event host
  • Report any inappropriate behaviour to the Event host
  • Respect others’ opinions and decisions
  • Consider yours and others safety throughout the Event
  • Drink responsibly and respect your limits
  • Seek not to be rude, lewd or offensive
  • Do not cause any hassle during the Event
  • Do not provoke or harass others
  • Do not resort to violence
  • Respond decently to rejection

For each Event organised, ACMA has strove to ensure the safety of all our Participants. Members, Subscribers and their Guests are solely responsible for behaving in accordance with our Code of conduct and health and safety instructions issued by the host venue. In the case of loss or damage incurred by Members, Subscribers, or Guests resulting from actions, omissions, or conduct of other Participants or other members of the public that occur prior to, during and after the Event, including, but not limited to, incidents caused by non-compliance with the Code of conduct and/or the health and safety recommendations of the venue by one of the Participants or other member of the public or from a lack of vigilance or negligence of one of the Participants, ACMA will not accept liability.

ARTICLE 8 – EXCLUSION OF A PARTICIPANT

Any behavior in contravention of article 7 may see a Participant receiving a warning or being excluded from an Event hosted by ACMA or if applicable, its subcontractor, particularly so if the Participant is intoxicated, risk the physical or mental safety of the Participant or any other third party or is harassing a third party. Exclusion will be the sole discretion of ACMA.

If a Participant is excluded during an Event, the Participant will not be entitled to a refund.

A Participant who receives a warning or exclusion from an Event organized by ACMA may be precluded from later registering for any other Event hosted by ACMA, or if applicable, its partners.

Finally, ACMA is at liberty to notify the relevant authorities if the Participant’s behaviour poses a risk to public order and safety.

ARTICLE 9 – LIABILITY

ACMA shall not be liable in situation where a force majeure (unforeseeable circumstance) results in the modification or cancellation or for property damage of any kind, which occurs during an Event and which is attributable to a Participant or third party at the Event.

ARTICLE 10 – TRIPS ANNOUNCED IN THE EVENTS SECTION

These Terms and Conditions are not applicable to travel services announced in the Events section.

These services will be subject to a contract signed directly between a Member or Subscriber and the trip organiser. Please refer directly to the terms and conditions of sale of the relevant service provider.

ARTICLE 11 – COMPLAINTS

The Participant should contact ACMA with any complaints as soon as is possible and no later than thirty (30) days from the date of the Event by any means allowing for acknowledgement of receipt using the contact details provided in article 14 below.

ARTICLE 12 – PERSONAL DATA

The information provided by Participants during their registration and participation in an Event allows ACMA, and if needed their partners, to offer and run Events.

Participants’ personal data is processed in compliance with the ACMA’s privacy policy available on the Website where the Services are purchased.

ARTICLE 13 – APPLICABLE LAW – LITIGATION

These Terms and Conditions are governed, interpreted and applied in accordance with the laws of England and Wales, subject to the statutory rules of the Member or Subscriber’s country of residence.

In the event of a dispute, if an amicable agreement cannot be reached, the competent authorities will be the courts of the consumer’s place of residence located in the UK.

ARTICLE 14. – WHO ARE WE?

The Services provided by ACMA to the Members and Subscribers pursuant to these Terms and Conditions, are offered by Afro-Caribbean Matchmaking Agency whose postal is Wilson’s Park, Monsall Rd, Manchester, M40 8WN.
