Terms of Service, Terms & Conditions and Refund Policy

PART A · GENERAL TERMS (apply to every service)

A1 · Who we are and how to reach us

These terms are between you and The Profit Experts Limited trading as the African Caribbean Matchmaking Agency (‘the Agency’, ‘we’, ‘us’) of Manchester, UK. Contact: support@blackdatingv.com. These General Terms apply to all our services; each service also has its own Schedule below, and where a Schedule differs from Part A, the Schedule governs for that service.

A2 · Eligibility and honesty

Our services are for adults aged 18 or over who are legally free to form a new relationship. By purchasing or using any service you confirm that all information you give us in applications, profiles, interviews and vetting is true, complete and not misleading. Because other members rely on your honesty for their decisions, material dishonesty, including dishonesty about identity, age, relationship status, intentions or criminal history, is a serious breach entitling us to suspend or terminate access; see Part E.

A3 · How your contract forms

Your contract with us forms when you complete payment for a service (or, for free services, when you book or register). For the Club and Premium services, ACTIVATION is a separate later step that only occurs after vetting, as described in the relevant Schedule. You will receive these terms, or a link to them, before payment; by paying you accept them.

A4 · Communications

By providing your details you agree that we may contact you about your booking and service, and, where you have opted in or another lawful basis applies, about newsletters and offers, by email, SMS and WhatsApp. You can opt out of marketing at any time through the unsubscribe method provided or by replying STOP. Service messages, including confirmations, introductions, safety notices and account notices, may continue while you hold an active booking or membership.

A5 · Our standard of service and its honest limits

We provide every service with reasonable care and skill. Two honest limits apply to everything we do. First, matchmaking outcomes: human relationships cannot be guaranteed. Except where a written guarantee is expressly included in your service (see Schedule 4), we promise the quality of the process, not a relationship outcome. Second, vetting: identity verification and criminal-record checks verify information available through the relevant process at the time of checking. They cannot guarantee future conduct, character, compatibility or safety. You remain responsible for your own dating decisions and personal safety, and we provide safety guidance to members.

A6 · Our materials

The book, workbooks, Modules, programme materials, articles, videos and other resources we provide are for your personal use only and remain our intellectual property. You must not copy, share, publish, distribute or resell them without our written permission, except where the law permits otherwise.

A7 · Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded, and nothing in these terms affects your statutory rights as a consumer. Subject to that, we are not liable for the acts or omissions of members or third parties, and our total liability to you in connection with a service is limited to the fees you paid for that service.

A8 · Complaints, law and disputes

Complaints: email support@blackdatingv.com. We aim to acknowledge complaints within three working days and respond fully within fourteen days. These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction, without affecting any statutory rights you may have to bring proceedings elsewhere.

A9 · Acceptable Use Policy

Our Acceptable Use Policy (AUP) forms part of these terms and applies to your use of our website, forms, communities, messaging channels, introductions and services. It is available at https://blackdatingv.com/acceptable-use-policy/. You must not use our services to engage in, facilitate, solicit, advertise, promote, threaten, encourage or assist unlawful or abusive conduct. This expressly includes human trafficking or sexual exploitation; child sexual exploitation and abuse (CSEA) or child sexual abuse material (CSAM); sexual violence or coercion; non-consensual intimate or sexual content; pornographic or sexually explicit content; scams, romance scams, fraud or financial exploitation; and any conduct that aids, abets, facilitates or encourages abuse towards another member or any other individual. Part E contains the core prohibitions and consequences.

A10 · Law enforcement and serious safety matters

Where we receive a credible report of serious unlawful conduct, an imminent risk of serious harm, or a lawful request from a competent law-enforcement authority, we may restrict access, stop introductions, preserve relevant records and disclose information where the disclosure is required by law or is otherwise lawful, necessary and proportionate. We verify law-enforcement requests and seek to disclose only the minimum information reasonably necessary for the stated purpose. PART B · SERVICE SCHEDULES

SCHEDULE 1 · FREE SERVICES: the Dating Masterclass and the Dating Discovery Conversation

What they are and the one rule that protects everyone

The Dating Masterclass (a free live online event) and the Dating Discovery Conversation (a free private consultation) are provided at no charge, with no obligation to purchase anything. One rule applies to Discovery Conversation bookings, stated at booking and in your reminders: slots are limited and demand in our community is high, so we operate a confirm-or-release system. We will ask you to confirm your slot before the call, and if we receive no confirmation by the stated deadline we may release your slot to another person and cancel the booking. You can rebook at any time. Cancelling or rebooking is free through the links in your confirmation message. No fees, no penalties, just honesty with everyone’s time.

SCHEDULE 2 · THE MEMBERS’ CIRCLE

What is included and how it runs

The Members’ Circle provides: the Right Partner Selection Blueprint tools and welcome pack, membership of our private community, and a monthly member teaching piece, for a term of 12 months. The Circle does not include introductions or matchmaking. NO AUTO-RENEWAL: your Circle membership never renews automatically. Near the end of your term we invite you to renew, and if you do nothing, it simply ends and you keep the materials already delivered.

The upgrade credit

If you upgrade to The Marriage-Minded Singles Club while your Circle membership is current, your £97 counts toward your Club fee, so £297 becomes £200 for three months and £497 becomes £400 for six months.

Refunds

You have a statutory 14-day cooling-off period from purchase. Because the Circle includes immediate access to digital content and the community, we ask for your express consent to begin immediately; our policy is nonetheless GENEROUS BY CHOICE: request a refund within 14 days of purchase, for any reason, and we refund you in full. After 14 days the fee is non-refundable, subject always to your statutory rights.

SCHEDULE 3 · THE MARRIAGE-MINDED SINGLES CLUB

What membership is

The Marriage-Minded Singles Club is a vetted introductions membership: every member is personally interviewed, identity-verified and criminal-record checked, and declares in writing that they are seriously seeking a committed relationship. During your term we make personal introductions between you and members we judge genuinely suitable. One considered introduction at a time, each with our reasons as suitable matches arise. WHAT WE PROMISE AND WHAT WE DON’T: we promise to operate the vetting and matching process described in these terms. We do not guarantee a particular number of introductions in a period, chemistry, or any relationship outcome, and no refund arises from those things alone; if suitable matches for you are genuinely scarce in a period, we will tell you honestly rather than send unsuitable ones.

Vetting and the activation gate

Your membership follows this order: payment → application → your written vetting consent → our checks → ACTIVATION. No introductions occur, in either direction, until your checks clear. IF YOUR CHECKS DO NOT CLEAR: we will tell you privately, your membership will not activate, and you will receive a FULL refund of your membership fee.

Term, renewal and conduct

Your term (three or six months) starts on ACTIVATION, not payment. Vetting time is never charged against your membership. NO AUTO-RENEWAL: near term end we offer you the choice; silence means the membership ends. Members must comply with Part E and the Acceptable Use Policy. Serious safety or integrity breaches may result in immediate removal.

Refunds and cancellation

14-day cooling-off from payment: full refund on request, provided no introduction has yet been made. After activation: fees are non-refundable for the remainder of the term except as required by law or under the checks-fail clause above. You may pause your membership once per term for up to [30] days by writing to us, and your end date extends accordingly.

SCHEDULE 4 · GET MATCHED BEFORE CHRISTMAS

What these services are

One-to-one services combining personal coaching and dedicated matchmaking. Your programme runs in two phases: PREPARATION (coaching, the workbook programme beginning with Modules, and building your Agreed Partner Criteria) followed by your MATCHING PHASE (our active search and personal introductions against those criteria). All coaching is one-to-one and paced from your own start date. There are no group cohorts.

Immediate digital delivery: important for your cooling-off rights

Module 2.5 is delivered to you electronically immediately on payment so you can begin the same day, and your printed workbook follows by post. By purchasing you expressly request immediate delivery of the digital materials and immediate commencement of the service, and you acknowledge that, for the digital content itself, this may affect your statutory cancellation rights once delivery begins. Your broader cancellation rights are set out below.

The 120-Day Match Guarantee

Where your service includes the 120-Day Match Guarantee, its terms are: (1) the guarantee window begins on the day your MATCHING PHASE opens, never at purchase, and you receive the start and end dates in writing in your Guarantee Commencement Notice; (2) we guarantee that within the window we will provide at least one suitable match, a personal introduction to an identity-verified, criminal-record-checked individual meeting the Agreed Partner Criteria recorded with you in writing; (3) during the window you receive introductions one considered person at a time and a written status update at least fortnightly, and quality beats speed. We never send an unsuitable introduction to satisfy a clock; (4) THE REMEDY: if we fail to provide a suitable match within the window, you receive a FULL refund of your fee. Not a credit, not an unrequested extension; (5) YOUR PART: the guarantee assumes your reasonable availability and good-faith participation. You may pause the window (travel, illness, family) by writing to us, and we confirm the revised end date in writing; declining an introduction that objectively meets your Agreed Partner Criteria does not restart or extend the window; (6) claims: write to us within [30] days of the window ending; refunds are processed within 14 days of agreement.

Refunds and cancellation

14-day cooling-off from payment: if you cancel within it, we refund in full LESS the value of what you asked us to deliver immediately, where the law permits that deduction. This may include digital materials supplied and coaching sessions already delivered, charged proportionately. After the cooling-off period: fees are non-refundable except (a) under the 120-Day Match Guarantee remedy above, (b) where we fail to deliver the service with reasonable care and skill and cannot remedy it, or (c) as otherwise required by law. If we terminate for your material dishonesty in vetting or a serious Part E breach, no refund is due except where the law requires otherwise.

SCHEDULE 5 · THE 90-DAY READY FOR LOVE CHALLENGE

What is included

A 90-day guided readiness programme: thirteen weekly lessons and exercises, the programme pack, and three one-to-one milestone calls (kickoff, midpoint, graduation). The programme is educational coaching; it does not include introductions.

Refunds

14-day cooling-off from purchase with immediate-start consent: cancel within it and we refund in full less any proportionate amount we are legally entitled to charge for service already delivered at your request, including any milestone call already held. After 14 days: non-refundable, but you may pause the programme once for up to [30] days by writing to us, and your remaining weeks resume after. Your statutory rights are unaffected.

PART C · REFUND & CANCELLATION POLICY — the one-page summary

Your cooling-off right, in plain English

For every paid service, consumer cancellation rights may apply for 14 days from purchase. Because some services begin quickly at your request, the effect on refunds depends on the service and what has already been supplied. Our stated policy is: MEMBERS’ CIRCLE: full refund, any reason, within 14 days. MARRIAGE-MINDED SINGLES CLUB: full refund within 14 days provided no introduction has yet been made. GMBC/PREMIUM: full refund less any amount lawfully chargeable for digital materials or coaching delivered at your express request. RFLC: full refund less any amount lawfully chargeable for services already delivered at your express request. To cancel: email support@blackdatingv.com or message us on WhatsApp with the word REFUND and your name. We process agreed refunds within 14 days to your original payment method.

After the cooling-off period

CIRCLE, CLUB and RFLC: non-refundable for the term, with the pause allowances stated in their Schedules, and always subject to statutory rights if we fail to deliver with reasonable care and skill. CLUB checks-fail: full refund if vetting does not clear and membership never activates. GMBC/PREMIUM: the 120-Day Match Guarantee refund applies exactly as written in Schedule 4 and the relevant Commencement Notice. NO AUTO-RENEWAL: no service described in this draft takes a further renewal payment without your explicit agreement.

PART D · VETTING, SAFETY & YOUR DATA

D1 · What our checks are and are not

For the Club and Premium services we require, with the appropriate notice and consent or other lawful basis as applicable, identity verification and a criminal-record check. Checks verify information available through the relevant official process at the time of checking. They are a filter, not a guarantee, and do not certify any person’s future conduct, character, compatibility or safety.

D2 · How we use your information

We use your data to run your service: your application and profile information to assess and make introductions; vetting data only for the purposes described in our privacy and vetting processes; and your contact details to communicate as A4 describes. INTRODUCTIONS: we share your first name, profile summary and photograph with a proposed match only when we propose the introduction, and full contact details only when both sides say yes. We do not sell your personal data. Vetting outcomes are restricted to authorised personnel and retained according to our applicable retention schedule and Privacy Policy.

D3 · Serious safety reports and law-enforcement disclosures

If we receive a serious safety report or information suggesting criminal conduct, we may pause introductions, restrict an account and preserve relevant records while the matter is assessed. We may report information to law enforcement or other competent authorities, or respond to their requests, where required by law or where another lawful basis permits disclosure and the disclosure is necessary and proportionate. Special-category and criminal-offence data receive additional legal assessment before disclosure. See our Law Enforcement Policy and Privacy Policy for further information.

PART E · CONDUCT CODE, PROHIBITED CONDUCT & TERMINATION

E1 · Respect, honesty and lawful use

Treat every member and individual with respect in introductions, communities and communications arising from our services. Do not harass, abuse, threaten, intimidate, stalk, discriminate against, blackmail, extort or deliberately deceive another person. Do not misuse the service for unauthorised commercial solicitation. Follow our safety guidance and report serious concerns to us promptly.

E2 · Human trafficking and sexual exploitation — zero tolerance

You must not use, or attempt to use, our website, communities, communications, introductions or services to recruit, transport, harbour, control, exploit, advertise, solicit or facilitate any person for human trafficking, forced labour, sexual exploitation, commercial sexual exploitation or any related abusive purpose. Any indication that a member is being coerced, controlled, exploited or trafficked may result in immediate suspension, preservation of relevant records and referral to the appropriate authorities.

E3 · Child sexual exploitation and abuse (CSEA) and child sexual abuse material (CSAM) — zero tolerance

Our services are strictly for adults aged 18 or over. You must not upload, send, request, possess through our systems, distribute, create, promote or facilitate child sexual abuse material, or engage in grooming, sexualisation, exploitation or abuse of any person under 18. This prohibition applies to real, manipulated, computer-generated or synthetic sexual content depicting or purporting to depict a child. Suspected CSEA or CSAM is treated as a serious safety matter and may be reported to law enforcement or other competent safeguarding authorities in accordance with law.

E4 · Sexual violence, coercion, non-consensual content and explicit content — prohibited

You must not threaten, promote, encourage, facilitate or engage in rape, sexual assault, sexual violence, coercion, sexual extortion or any non-consensual sexual activity. You must not create, record, share, threaten to share or distribute intimate or sexual images, recordings or other sexual content without the clear consent of the person depicted or recorded. This includes non-consensual intimate imagery and sexually explicit deepfakes or manipulated content. You must not use Agency-managed channels to distribute pornography or other sexually explicit images, videos, audio or graphic sexual content, or to solicit sexual services. Reasonable, non-graphic discussion of relationship or sexual-health matters is not prohibited merely because the subject is sexual.

E5 · Scams, fraud and financial exploitation — prohibited

You must not use our services for scams, fraud, romance scams, impersonation, identity theft, deceptive fundraising, financial exploitation or obtaining money, goods, services, banking details, passwords, gift cards, cryptocurrency or investments by deception, coercion or abuse of trust. Material dishonesty about identity, relationship status, intentions or circumstances is a serious breach. We may restrict accounts where fraud or financial exploitation is reasonably suspected while we assess the report.

E6 · No aiding, abetting, encouraging or facilitating abuse

You must not aid, abet, encourage, instruct, recruit for, conspire in, facilitate, conceal or materially assist any conduct prohibited by this Part E or the Acceptable Use Policy, whether the target is another Agency member or any other individual. Attempting to arrange prohibited conduct through a third party is treated the same as carrying it out directly.

E7 · Reporting, suspension, evidence preservation and cooperation

Reports should be sent to support@blackdatingv.com. We may temporarily suspend an account, stop introductions, remove access to communities, restrict communications and preserve relevant records while a serious report is assessed. Where appropriate and lawful, we may provide relevant information to police, the National Crime Agency, courts, regulators, safeguarding authorities or other competent authorities. We seek to protect complainants and witnesses on a need-to-know basis, but we cannot promise secrecy where disclosure is required by law or necessary for a lawful safety response. We will not knowingly alert a suspected offender where doing so is prohibited by law or would create a serious safety risk.

E8 · Consequences of breach

Minor breaches may receive a written warning or restriction where we reasonably consider that appropriate. Serious breaches, including human trafficking, sexual exploitation, CSEA/CSAM, sexual violence or coercion, non-consensual intimate content, serious fraud, threats, stalking, material dishonesty, or aiding or encouraging abuse, may result in immediate suspension or termination without prior warning. Refunds following termination are governed by the relevant service Schedule, consumer law and the circumstances of the breach. We may also decline or end membership where we reasonably judge the service is not suitable for someone’s circumstances. If WE end a paid membership other than for your breach, we refund any unused portion of the term pro rata unless another remedy is agreed or required by law.
